Most family law disputes about property and spousal maintenance are finalised with consent orders. The other option, if the parties agree, is a financial agreement.
A financial agreement, must meet strict requirements. Each party must receive separate independent legal advice before signing it.
There are three types of financial agreements:
- entered into before marriage. These are commonly known as "prenuptial agreements" or “prenups”
- entered into before divorce, either before or after separation
- entered into after a divorce
