Most family law disputes about property and maintenance are finalised with consent orders. The other option, if the parties agree, is a financial agreement.
A financial agreement must meet strict requirements. Each party must receive separate independent legal advice before signing it.
- There are different types of financial agreements:
- entered into before marriage. These are commonly known as "prenuptial agreements" or “prenups”
- entered into before a de facto relationship commences
- entered into during a marriage, either before or after separation
- entered into during a relationship
- entered into after a divorce
- entered into after the end of a de facto relationship
